Abstract

Whether a local arbitration instituted in Guatemala pertained the same measures as concerned a Dominican Republic-Central America-United States Free Trade Agreement (‘DR-CAFTA’) claim.

Whether the validity of a waiver contained in the DR-CAFTA and jurisdiction of the Tribunal would be affected if the two sets of proceedings were the same.
