Abstract

Whether Paraguay had consented to International Centre for Settlement of Investment Disputes (‘ICSID’) jurisdiction by virtue of signing the Agreement Between the Republic of Peru and the Republic of Paraguay for the Promotion and Reciprocal Protection of Investments (‘Paraguay/Peru BIT’) providing for arbitration before ICSID.

Whether Paraguay was required to have authorized the investment in order for it to fall within the protection of the Paraguay/Peru BIT.

Whether the bankruptcy proceeding commenced by Mr Olguin before the Paraguayan courts precluded him from pursuing the recovery of his investment through arbitration before ICSID.
